Why We Removed the Sunrise Clause at Flourish Amargo
Buying off-the-plan takes trust. You are committing to a home that is still taking shape, placing your deposit with a developer and believing they will deliver exactly what they promised. That trust should never be taken lightly.
At Sherpa, we believe the way we do business matters as much as what we build. It is why we made the decision to remove the sunrise clause from all Flourish Amargo contracts.
What is a sunrise clause?
Just as there is a sunset clause, there is also a sunrise clause — and it is far less talked about. The sunrise clause sets a date by which a developer must confirm that a number of key milestones have been satisfied. Specifically, Sherpa must confirm with buyers that sufficient pre-sales have been achieved to give the project strong commercial foundations, that construction funding has been secured on satisfactory terms, that the land has been acquired, that all required government approvals are in place, and that the overall feasibility of the development is confirmed.
If those conditions are met, the project moves forward and your contract remains active. If, for any reason, those conditions are not met by that date, buyers would be notified and the contract could be terminated, with deposits returned in full.
Sherpa has never exercised this clause. In fact, in past projects it has been waived early — before the date was even reached. Sherpa would not bring contracts to market if it were not deeply confident in what it is building. Delivering 100% of every project it has ever started is a track record worth protecting.
Why we removed it
Construction at Flourish Amargo is well and truly under way. Our builder is on site, the program is on track, and we are not going anywhere. Every condition the sunrise clause was designed to protect against has already been satisfied. Removing it is simply the honest thing to do.
